Assessments and Evaluations
The initial step in the special education process is typically an assessment/evaluation of the child. Your school district is legally required to identify and evaluate all children who are eligible for special education services, and you may have the right to obtain a private independent assessment of your child at the school district's expense. Understanding your rights and obtaining a proper evaluation of your child is critical in ensuring your child receives all entitled educational services.
Individualized Education Plan
The IEP is a written plan developed by the parents, teachers, and other qualified individuals that describes your child's performance, goals, and services. It is paramount that any educational services that your child needs and is entitled to are placed in the IEP. The drafting of the IEP is intended to be a collaborative process between the parents and school district. Unfortunately, the school district can often dominate the meeting and refuse to include all necessary services for your child in the IEP. Due Process Hearings
Sometimes it may be necessary to file a claim against the school district in order to obtain the educational services that your child deserves and needs. The process begins with filing a detailed complaint against the school district. A resolution session with the school district must then occur within fifteen days. Typically, the parties cannot resolve their differences at the resolution session and then attend a mediation where the parties present their case to a neutral third person who attempts to resolve the conflict. If the parties cannot resolve their differences at mediation, the case will go to trial in front of an administrative law judge. A trial can last many days, and requires the presentation of evidence and examination of witnesses.
